Virtual Stadium Tour Terms and Conditions

  • Welcome to the Arsenal Virtual Stadium Tour (“Virtual Stadium Tour”) at www.tour.arsenal.com. The Virtual Stadium Tour is operated by Visual Immersion Ltd, a company registered in England and Wales under number 10437122 whose registered office is at 19 King Street, King's Lynn, Norfolk, United Kingdom, PE30 1HB, on behalf of The Arsenal Football Club Limited (‘Arsenal’, ‘we’, ‘our’, ‘us’). In these terms and conditions, ‘you’ and ‘your’ means you as the user of our Website.
  • These Terms and Conditions govern your use of the Virtual Stadium Tour. By accessing the Virtual Stadium Tour, you are accepting and agreeing to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not access the Virtual Stadium Tour. You should read all the Terms and Conditions prior to accessing the Virtual Stadium Tour. You should also save and/or print out a copy of these Terms and Conditions for future reference.
  • The privacy of your personal information (such as your name, e-mail address, address and other contact details) is important to us. Please see our Privacy Policy at www.arsenal.com/privacy-policy for details of how we may process your personal information.
  • These Terms and Conditions, together with the Privacy Policy and the terms and conditions that apply to your use of particular areas of the Virtual Stadium Tour shall be collectively referred to as the “Agreement“. This Agreement constitutes the entire agreement between you and us.
  • Arsenal reserves the right to revise the Agreement in our sole discretion at any time and without prior notice to you by updating this posting, such changes to be effective prospectively. Your continued use of the Service after a change has been posted constitutes your acceptance of the change thereafter.
  • Access to the Emirates Stadium Tour Virtual Tour (‘Virtual Stadium Tour’) is solely available through the purchase of a unique, numerical access code via the Arsenal Direct website (“Access Code“).
  • By placing an order for an Access Code via Arsenal Direct, you promise that you are legally capable of entering into binding contracts and you are at least 18 years old. Your purchase of an Access Code via Arsenal Direct is subject to the Arsenal Direct Terms and Conditions of Sale accessible at https://arsenaldirect.arsenal.com/termsAndConditions.
  • The Access Code shall be delivered to you via email to the email address provided at the point of purchase.
  • Access Codes shall be valid for a period of six (6) months from the date of purchase. After such date, the Access Code will no longer provide access to the Virtual Stadium Tour.
  • An Access Code is deemed to be activated once it is typed into the Virtual Stadium Tour website and submitted, whether or not the Tour itself is entered.
  • This Access Code will provide access to the Virtual Stadium Tour for the “Activation Period” which shall be either: (a) forty-eight (48) hours from first activation; or, if sooner, (b) after the Access Code has been inputted up to the maximum of ten (10) occasions (“Total Access Allowance”). After the Access Code has been input on ten occasions, the Access Code will no longer provide access to the Virtual Stadium Tour. If you remain inactive whilst logged into the Virtual Stadium Tour for a period of thirty (30) minutes or greater, you will be automatically logged out of the Virtual Stadium Tour and this will count as one of your Total Access Allowance.
  • Access to the Virtual Stadium Tour constitutes a licence to use the service for a limited period as per these terms and conditions and does not confer any form of ownership on the user.
  • Access to the Virtual Stadium Tour is for personal and domestic use only. You must not share your Access Code with any other person except: (1) you shall be entitled to permit other members of your household to use the Access Code; and (2) you shall be entitled to purchase an Access Code for gifting to a friend or family. You must not offer for sale, promote or sell Access Codes to third parties whether or not for commercial purposes.
  • An Access Code can only be purchased by a person over 18 years old, as per these Terms and Conditions and it is the responsibility of parents or legal guardians to supervise children when online and accessing the Virtual Stadium Tour.
  • Access Codes cannot be resold or offered for resale. Access Codes resold or offered for resale in breach of this condition will be cancelled and secondary buyers will not be able to gain access to the Virtual Stadium Tour.
  • You may cancel your purchase of a Virtual Stadium Tour access code within 14 days of purchase, provided it has not been activated. You can cancel via your online retail account with us (if you have one) or by following the procedure as set out in the Confirmation E-mail. If you submit a cancellation request in accordance with these Terms and Conditions, we will refund you the full purchase price of your order within 14 days of receiving your cancellation request. Unless expressly agreed otherwise by us, we will make such refund using the same method of payment that you used for the original order. By accepting these Terms and Conditions, you consent and acknowledge that once the Access Code has been activated the right to cancel no longer applies.
  • No refunds for the purchase of Access Codes will be given outside of the procedure in section 16.
  • The materials and content made available on or through the Virtual Stadium Tour are protected by copyright and other intellectual property rights. The Arsenal Football Club Limited reserve all rights in and to the Virtual Stadium Tour not expressly granted to you in these Terms.
  • Subject to the terms of this Agreement, we grant you a non-exclusive, non-transferable, revocable, limited right to access and view the Virtual Stadium Tour and all data, information, software graphics, images, text, posts and other content on the Virtual Stadium Tour, (“Materials“) on a single device strictly in accordance with this Agreement.
  • You may only view and use the Virtual Stadium Tour and Materials for your own personal, non-commercial use. We expressly reserve all intellectual property rights in and to the Virtual Stadium Tour and the Materials and your use of the Virtual Stadium Tour and Materials is subject to the following restrictions.
  • You agree that as a condition of your use of the Virtual Stadium Tour, you agree not to and shall not permit, enable or facilitate any third party to:
    • remove any copyright or other proprietary notices contained in the Materials;
    • circumvent or disable any content protection system or digital rights management technology used in connection with the Virtual Stadium Tour to control access to the Virtual Stadium Tour;
    • copy, record, photograph, screenshot, screen-record, screen-capture or capture by any other means the Virtual Stadium Tour or any content contained within it (except for the images which are expressly permitted for download in the ‘Downloads’ section of the Virtual Stadium Tour website);
    • reproduce, publish, publicly display, rebroadcast, perform, disseminate, distribute or communicate to the public the Virtual Stadium Tour and any content contained within it or otherwise use the Materials for any public or commercial purpose;
    • use any Materials or content from the Virtual Stadium Tour in any manner that may infringe any intellectual property right, proprietary right, or property right of us or any third parties;
    • move, decompile, reverse-engineer, disassemble, or otherwise reduce to human- readable form the Virtual Stadium Tour or any content contained within it, its underlying technology, any digital rights management mechanism, device, or other content protection or access control measure incorporated into the Virtual Stadium Tour or the website used to access it;
    • modify the Virtual Stadium Tour or any content contained within it;
    • access or use the Virtual Stadium Tour or any content contained within it in a manner that suggests an association between you and/or any other party with our products, services or brands;
    • redistribute or sell any part of the Virtual Stadium Tour or create a new product or service based on the Virtual Stadium Tour;
    • mass download or create bulk feeds of the Virtual Stadium Tour;
    • use the Virtual Stadium Tour or any content contained within it for any commercial or business related use or in any commercial establishment or area open to the public (e.g., lobby, bar, restaurant, diner, stadium, casino, club, cafe, theatre, etc.) or build a business utilizing the Virtual Stadium Tour or any content contained within it, whether or not for profit;
    • interfere with the operation of or damage the Virtual Stadium Tour;
    • bypass, modify, defeat, tamper with or circumvent any of the functions or protections of the Virtual Stadium Tour or any content contained within it;
    • access, monitor or copy, or permit another person or entity to access, monitor or copy, any element of the Virtual Stadium Tour or any content contained within it using a robot, spider, scraper or other automated means or manual process;
    • damage, disable, overburden or impair the Virtual Stadium Tour or any content contained within it;
    • use the Virtual Stadium Tour or any content contained within it in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms and conditions;
    • share your access code with third parties; or
    • otherwise allow third parties to violate the above restrictions.
  • Any attempt to perform any of the restrictions listed in Section 21 above is a violation of the rights of Arsenal Football Club Limited.
  • The Stadium Tour can be viewed on most devices with internet access, including laptops, desktop computers, tablets and mobile devices. For the best possible experience, we recommend the larger screen offered by laptops, desktop computers or tablets or connect your laptop or tablet to your television for a big screen experience. Internet access is required to view the tour. We recommend a minimum speed of 5 Mbps.
  • The Virtual Stadium Tour and the content contained within it may contain inaccuracies and typographical errors. We do not warrant the accuracy or completeness of the Virtual Stadium Tour and the content contained within it. Any reliance on any such opinion, advice, statement, or other information shall be at your sole risk. We reserve the right, in our sole discretion, to correct any errors or omissions in any portion of the Virtual Stadium Tour and the content contained within it and to make any changes to the features, functionality or content of the Virtual Stadium Tour and the content contained within it at any time. We reserve the right in our sole discretion to edit or delete any documents, information or other content on the Virtual Stadium Tour and the content contained within it.
  • Any discount offered for purchases on Arsenal Direct is subject to its own individual Terms and Conditions. Such purchases are subject to the standard Terms and Conditions for Arsenal Direct in accordance with paragraph 7 of these Terms and Conditions. Any such discounts may be added or removed by Arsenal at its sole discretion.
  • We will use all reasonable endeavours to maintain the availability of the Virtual Stadium Tour and access to it, but there may be periods of necessary downtime including but not limited to updates and upgrades to the Tour and background systems. During these periods Access Codes will not be able to be activated but will remain on sale for future use.
  • These terms and conditions are binding on you and us and on our respective successors and assignees. No other person shall have any rights to enforce any of its terms.
  • You may not transfer, assign, charge or otherwise dispose of any of your rights or obligations arising under these terms and conditions, without our prior written consent.
  • We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under these terms and conditions at any time, but this will not affect your legal rights or our obligations under these terms and conditions.
  • We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control (Event Outside Our Control).
  • An Event Outside Our Control includes any act, event, non-occurrence, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
    • strikes, lock-outs or other industrial action;
    • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
    • fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
    • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
    • impossibility of the use of public or private telecommunications networks; and
    • the acts, decrees, legislation, regulations or restrictions of any government.
  • Our performance of any of our obligations to you will be suspended for the period that the Event Outside Our Control continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Event Outside Our Control to a close or to find a solution by which our obligations to you may be performed despite the Event Outside Our Control. If the Event Outside Our Control continues for a period of thirty (30) days you may elect to cancel your order of an Access Code. If you wish to cancel, you must contact us in order to inform us of the same, and we will issue you with a full refund.
  • We have the right to revise and amend these terms and conditions from time to time including, without limitation, to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
  • Any contract between you and us will be governed by the policies and terms and conditions in force at the time that you make use of this service, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority, or if we notify you of the change to those policies or these terms and conditions before we send you the Confirmation E-mail (in which case we may assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Confirmation E-mail).
  • If you breach these terms and conditions and we take no action against you, this will not act as a waiver of any of our rights or remedies under these terms and conditions or otherwise.
  • If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be treated as deleted from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
  • We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any contract between you and us. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
  • Please note that these terms and conditions are governed by English law. This means that a contract between you and us for the purchase of Products through our site and any dispute or claim arising out of or in connection with it (including, but not limited to, non-contractual disputes and claims) will be governed by English law.
  • You can bring proceedings in respect of these terms and conditions in the English courts. However, as a consumer, if you live in Scotland you can bring legal proceedings in respect of these terms and conditions in either the Scottish or the English courts; if you live in Northern Ireland you can bring legal proceedings in respect of these terms and conditions in either the Northern Irish or the English courts.
  • You will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions, including clause 28, affects your rights as a consumer to rely on such mandatory provisions of local law.
